Bankruptcy, conviction and arrangements with creditors

Bankruptcy (also Debt Relief Orders)/Entering into an arrangement with creditors/ Having an unspent criminal conviction/Being found guilty of a civil offence/Having a County Court Judement is not necessarily a bar to registration, but we need to be sure of the suitability of our students to maintain public confidence in the accountancy profession.

In order for us to progress the application and make a fair and just decision on whether a student should be admitted, we require the following information to be sent to us along with your registration form –


Bankruptcy

  • When you were declared bankrupt
  • When your bankruptcy was discharged/is due to be discharged
  • The circumstances leading up to your bankruptcy (ie a full ‘step by step’ account of what led to your bankruptcy, how the debt arose and what you used the money for)
  • The amount you owed at the date of bankruptcy
  • A breakdown of what the debt consisted of and who your creditors are (for example, how many credit cards/loans you had and approximately how much was owed on each)
  • A copy of your Bankruptcy Order and Certificate of Discharge from bankruptcy (if available)
  • Any mitigating circumstances surrounding your bankruptcy (if appropriate)
  • Any other information you consider would be helpful to us in assessing your application.

 

Agreement with creditors (this includes both formal and informal agreements)

  • the start date of your agreement
  • when your agreement ended/is due to end
  • The circumstances leading up to your agreement (ie a full ‘step by step’ account of what led to your agreement, how the debt arose and what you used the money for)
  • The amount you owed at the start date of your agreement
  • A breakdown of what the debt consisted of (for example, how many credit cards/loans you had and approximately how much was owed on each)
  • A statement from the Supervisor of your agreement/your creditors confirming that your agreement is progressing satisfactorily
  • Any mitigating circumstances surrounding your agreement (if appropriate)
  • Any other information you consider would be helpful to us in assessing your application.

 

Conviction (unspent)

  • What your conviction was for
  • The circumstances leading up to your conviction (ie a full ‘step by step’ account of what led to your conviction)
  • When you were convicted and the court which convicted you
  • What sentence you received
  • A copy of your Certificate of Conviction (this is an official document from the court which convicted you, confirming what your conviction was for and the sentence you received) or a copy of a recent CRB disclosure detailing this information if you have one
  • Any other information you consider would be helpful to us in assessing your suitability.

 

County Court Judgment (CCJ)

  • The judgment date
  • How many creditors you have
  • When your CCJ was/will be removed
  • The circumstances leading up to your CCJ (i.e. full 'step by step' account of what led to your CCJ, how the debt arose and what you used the money for)
  • The amount you owed at the point of judgment
  • A breakdown of what debt consisted of (e.g. how many credit cards/loans you had an approximately how much was owed on each)
  • A statement from your creditor(s) and/or the County Court (if subject to an administration order) confirming that your payments are progressing satisfactorily
  • Any mitigating circumstances surrounding your CCJ (if appropriate)
  • Any other information you consider would be helpful to us in assessing your application.
