Misconduct
- She has been acting as a trust or company service provider without being registered with HMRC to do so, in breach of Regulation 56 of the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017.
- She has been providing or holding herself out as providing the following services whilst not being licensed by AAT to do so, in breach of Regulation 6.4 of AAT’s Licensing Regulations 2024:
- Personal Income Tax; and/or
- Company Secretarial Services (TCSP); and/or
- Financial accounts and accounts preparation for statutory purposes; and/or
- Business Income Tax; and/or
- Corporation Tax
Finding
By reason of the conduct set out in the Allegations above, Anna Szczawinska is guilty of misconduct pursuant to Article 21 of AAT’s Articles of Association.
Order
- Severely reprimanded for a period of three years.
- Fined £2,000.00.
- Issued a warning regarding future conduct, to include the following:
- Not to act as a trust or company service provider (TCSP) without being appropriately licensed and/or authorised to do so.
- Not to provide and/or offer to provide any services she is not licensed by AAT to do so, including but not exclusive to personal income tax, company secretarial services, financial accounts and accounts preparation for statutory purposes, business income tax and corporation tax.
- To cease any publication of the provision and/or offering of services that fall outside the scope of her AAT licence. This includes, but is not limited to, any such references on the Firm’s publicly accessible website. A deadline of 15 days from the issuing of any closure document will be given to modify such conduct.
- That failing to comply with this warning will result in AAT exercising its right to terminate her bookkeeper’s licence. This termination will also constitute expulsion of her AAT membership for an indefinite basis in accordance with AAT’s Licensing Regulations.
Consent
The decision of the Investigations Team shall stand as an Order of the Association pursuant to Regulations 5.2 and 5.3 of the Disciplinary Regulations.
