Misconduct

  1. For an unknown period up until on or around 17 October 2024, he did not comply with his obligations under the Money Laundering Regulations in force while providing accountancy services on a self-employed basis. Specifically, he failed to:
    • have in place any or any adequate procedures to report discrepancies to Companies House concerning persons of significant control in connection to limited company clients and/or limited liability partnership clients; and/or
    • perform and document a comprehensive firm-wide risk assessment; and/or
    • document client due diligence measures effectively; and/or
    • document anti-money laundering training undertaken by staff
  2. He failed to issue client engagement and client disengagement letters to one or more clients in full compliance with AAT’s Client Care Policy
  3. He failed to demonstrate that he had undertaken continuing professional development in all the areas he was licensed to offer services
  4. For a period of five years, he failed to maintain the requisite level of professional indemnity insurance (PII) as set out in AAT’s PII Policy.

Finding

Grounds for disciplinary action existed and the matter was suitable for exercise of the Investigations Team's powers under the Disciplinary Regulations.

Order

By reason of the conduct set out in the Allegations above, Murat Yilmaz is guilty of misconduct pursuant to Article 21 of AAT’s Articles of Association.

Consent

Murat Yilmaz is hereby: 

  1. Reprimanded for a period of three years
  2. Fined £5,000
  3. Deemed ineligible to hold fellow members (FMAAT) status for a period of three years
  4. Warned about his future conduct.
