- She retained commissions on four occasions totalling approximately £1,001.82 for the referral of one or more clients to an Independent Financial Advisor without obtaining consent.
- She failed to ensure her professional indemnity insurance (PII) policy was fully retroactive and covered the provision of limited assurance engagement services in contravention of Paragraphs 5.1(c) and 5.4 of AAT’s Professional Indemnity Insurance (PII) Policy.
Finding
By reason of the conduct set out in the Allegations above, Samantha Stokes is found to have committed misconduct pursuant to Article 21 of AAT’s Articles of Association.
Order
- Reprimanded for a period of one year.
- Warned that she must ensure she is familiar with – and complies with – all relevant guidelines, policies and regulations that govern her membership and licence and that failure to do so again in the future may result in the imposition of a higher sanction.
Consent
The decision of the Investigations Team shall stand as an Order of the Association pursuant to Regulations 5.2 and 5.3 of the Disciplinary Regulations.
